Published On:Thursday, April 25, 2019
When the new data protection legislation came into force on 1 August 2018, a transitional period was included to allow controllers time to make changes. The transitional period ends on 25 May 2019.
By that date controllers must fully comply with the following requirements:
Transparency and privacy notices
Individuals must be provided with concise, transparent, intelligible and easily accessible information, using clear and plain language, about the processing of their personal data.
The requirements are set out in Articles 12, 13 and 14 of the Applied GDPR and further information about transparency can be found at: https://www.inforights.im/organisations/data-protection-law-2018/principles-of-data-protection/lawfulness-fairness-and-transparency/transparency/
If a controller relies on consent to process personal data, consent must meet the new requirements set out in the definition (Article 3) and the conditions for consent (Article 7). Controllers must be able to demonstrate that the data subject gave valid consent to the processing.
More information about consent can be found at: https://www.inforights.im/organisations/data-protection-law-2018/principles-of-data-protection/lawfulness-fairness-and-transparency/lawfulness/consent/
